Welcome to POPEI! POPEI is committed to talent development in the broadest sense of the word. That is why POPEI has all kinds of facilities that receive different visitors. To ensure that this runs smoothly, the following general terms and conditions and rules apply.
1. General house rules
1.1 POPEI cannot be held liable for loss and/or theft of personal property.
1.2 It is not allowed to intimidate, threaten, treat indecently and/or insult the staff and other visitors.
1.3 It is prohibited to use or carry weapons when visiting POPEI.
1.4 Since 1 July 2008, a general smoking ban has been in effect for the catering industry. This applies to the entire POPEI building (fire brigade costs arising from fire/smoke reports are recovered from the responsible band/person).
1.5 The use of and trade in soft and/or hard drugs is prohibited within POPEI, on the POPEI terrace and in the space between the building and the terrace.
1.6 It is forbidden to destroy property of POPEI and its users.
1.7 Throw waste in the appropriate waste bins (chemical waste in the chemo box!)
1.8 Costs resulting from misconduct, cleaning, repair, etc. will be charged to the responsible band/person.
1.9 It is prohibited everywhere in POPEI, including in rehearsal rooms, to consume any food or drink brought along.
1.10 Follow the instructions of the personnel in the event of fire and/or calamities.
1.11 Also behave outside the 4 walls of POPEI. Do not cause a nuisance when entering or leaving the building, do not leave any mess behind and keep the sound volume low in the vicinity of POPEI.
2. Rehearsal Rooms
2.1 Use of rehearsal rooms and equipment
2.1.1 The rehearsal rooms are only accessible to registered users and students, staff is justified in removing unauthorized visitors.
2.1.2 Always return bottles, glasses and cups to the bar after rehearsal. Throw rubbish in the waste bins.
2.1.3 The vocal system is only suitable for vocals and keyboards, so not for connecting stringed instruments.
2.1.4 Keep the door closed during rehearsals.
2.1.5 Always return items borrowed from POPEI to the person from whom you received them. If rented equipment was in lockers, put them back afterwards.
2.1.6 Switch off vocal system/amplifiers after rehearsal and close rehearsal room when you leave.
2.1.7 Make sure you leave the rehearsal room at the agreed time.
2.1.8 After the rehearsal, return the clipboard with key to the bar.
2.2 Reservations for rehearsal rooms
2.2.1 Confirmation & contracts: the reservation is only finalized after the payment has been completed. The amount of that payment is always 12 rehearsals or less if less is chosen.
2.2.2 If you opt for an annual contract and confirm it by paying the first 12 rehearsals, you enter into an agreement for one year in which you are obliged to also make the other payments. Contracts cannot be canceled in the meantime.
2.2.3 Moving rehearsals and/or adding backline later:
- Rehearsals on Monday to Friday can be moved or changed until 5 p.m. the same day, or up to 2 hours in advance if it concerns a daytime rehearsal.
- Rehearsals on Saturday or Sunday can be moved or changed until 5 p.m. Friday.
- If you move from the weekend to weekdays, you have to pay extra, the system shows how much that is and you can pay it immediately.
- If you move from weekday to weekend you will not get a refund.
- You can reschedule a rehearsal to a date up to a maximum of 30 days after the original rehearsal date, provided it falls within the validity of the quarterly or annual contract. The validity of a single rehearsal is 6 months.
2.2.4 Canceling rehearsals: it is not possible to cancel rehearsals or backline items. Can't you rehearse? Then reschedule the rehearsal to another time (see Article 2.2.3).
2.2.5 If you indicate that you are a student and/or youth band and therefore receive an extra discount, you must send a copy of the passports and/or student cards before your first rehearsal.
2.2.6 The rooms to be rented all have a singing installation, but are rented as standard without a backline. A backline can be rented separately.
3. Hall rental
3.1. Hall rental - General
3.1.1 There is an agreement between POPEI and you from the moment the latter has signed the quote or agreement issued.
3.1.2 All offers made by the lessor and agreements entered into for the rental of spaces, the provision of services/work and all legal relationships between the lessor and the customer are exclusively subject to these general terms and conditions.
3.1.3 When entering into an agreement (signing the quotation) you indicate that you agree with these general terms and conditions. The latest applicable version of these general terms and conditions is deemed to apply to all subsequent agreements.
3.1.4 It will be determined in consultation whether you can or want to use the publicity expressions of POPEI, such as mention on the website or monthly poster. You hereby commit yourself to the correct use of the POPEI logo. The logo may not be modified under any circumstances.
3.1.5 The agreement is emphatically not a normal rental contract, but a usage contract in which the temporary use of our facilities is laid down.
3.1.6 If concert hall use forms part of the agreement, the following applies: to monitor the quality of the productions, it is mandatory when using light and sound equipment that at least 1 technician from POPEI is always present during the entire activity, so also during the preparations.
3.1.7 All materials that you bring yourself outside of POPEI must be fireproof and must meet the requirements according to Dutch legislation.
3.1.8 To protect the technical equipment and installations, it is not permitted anywhere in the entire accommodation to use color powder, confetti, glitter or other fine dust materials.
3.2 Room rental - Reservation and bookings
3.2.1 All offers provided by POPEI are without obligation, so with the express proviso that there is only an obligation on the part of POPEI if the agreement signed by you is in POPEI's possession.
3.2.2 If POPEI has not yet received the agreement signed by you and POPEI can rent out the room (rooms, rooms) to a third party, POPEI will inform you immediately and you must indicate immediately whether you have already then do not wish to take advantage of the POPEI offer.
3.2.3 In connection with the coordination with the other programming and the scheduling of personnel, you must return the submitted quotation signed and signed to POPEI within 7 days. In case of adjustment in the offer, a new period of 7 days applies.
3.3 Room rental - Use of the rented property
3.3.1 It is not allowed to use the space for an activity other than that specified in the agreement or reservation, to rent it out to third parties or to give it in use.
3.3.2 You are obliged to leave the used rooms as they were found. That is to say: all materials used that have not been placed or applied by POPEI must be removed after the end of the activity. Any necessary cleaning costs will be invoiced on subsequent calculation.
3.4 Room hire – Payment
3.4.1 If price agreements are included in an agreement concluded with POPEI, a payment term of 14 days applies.
3.4.2 You are responsible for the correct and punctual payment of bills and invoices and pay them on the correct date, stating the reference of the agreement and name. If you fail to pay the amount on time, you must reimburse POPEI for all costs that may arise from the collection, both judicial and extrajudicial.
3.4.3 In case of a down payment: if you do not pay the down payment on time, POPEI reserves the right to dissolve the agreement and thereby cancel the activity. This corresponds to 'cancellation within 2 weeks of the event' (see 3.5.3) and then a cancellation fee will be charged: 50% of the total amount excluding VAT.
3.5 Room rental - Termination and/or cancellation of the agreement by the customer
3.5.1 You have the right to cancel your reservation with POPEI in the event of unforeseen circumstances that prevent the reservation from taking place. In the event of cancellation of an agreement, the General Terms and Conditions remain in full force and any cancellation costs must be paid as stated under 3.5.3.
3.5.2 You have the right to cancel the reservation free of charge in the event that POPEI does not comply with agreements.
3.5.3 If you want to cancel your reservation, the cancellation costs will be charged according to the following arrangement:
- Cancellation within 2 weeks of the event → 50% of the total amount excluding VAT.
- Cancellation within 1.5 months of the event → 15% of the total amount excluding VAT.
- Cancellation outside 1.5 months of the event is free of charge.
3.5.4 In case of reservations where catering is provided and it can no longer be canceled, the costs will be charged. These costs correspond to the agreed price in the agreed quotation between the lessor and the customer.
3.5.5 In the event that POPEI has had to hire materials for the reservation and this rental can no longer be canceled, the costs will be charged for this. These costs correspond to the agreed price in the agreed quotation.
3.5.6 We appreciate early notification of a cancellation by email or telephone, but the actual cancellation or cancellation can only be made by email with confirmation from us.
3.6 Room rental - Dissolution of the agreement by the landlord
3.6.1 POPEI has the right to cancel reservations in case of unforeseen circumstances.
3.6.2 POPEI may cancel or terminate the rental contract before the rental commences:
a. if you do not comply with the provisions of the contract or if you endanger others or otherwise behave in a disruptive manner.
b. if the rental contract cannot go ahead due to reasons of force majeure that disrupt or endanger the customer's stay in POPEI.
c. if you endanger POPEI's reputation.
d. in the event that the relationship between you and other customers or you and POPEI is seriously disrupted.
3.6.3 POPEI shall under no circumstances be obliged to pay any form of compensation.
3.7 Room hire - Liability
3.7.1 POPEI cannot be held liable in any way; neither by customers, nor by users, clients and visitors. This applies to possible material and immaterial damage and/or trading loss as a result of staying within POPEI as well as for possible damage as a result of the activities offered by customers.
3.7.2 POPEI cannot be held liable for theft, loss or destruction of property.
3.7.3 POPEI will settle all damage and/or pollution caused by you as a user. You are also fully liable for all additional repair and/or cleaning costs as a result of this damage and/or pollution. POPEI is entitled in advance to always and still hold you liable if the damage caused has not been settled, or has not been settled properly, or if the costs paid on the spot have not been paid in full by you, or if the payment of the estimated damage has been recovery appears to be insufficient. All related (collection) costs are fully borne by you as a user.
3.8 Room hire - Amendment of these regulations
Changes or amendments to the general terms and conditions or the house rules can never lead to dissolution of the agreement, unless there is such a serious change or interest that makes it impossible for the customer to carry out the planned activity.
3.9 Room hire - Applicable law in case of disputes
3.9.1 In case of disputes between POPEI and the customer, Dutch law applies.
3.9.2 Possible disputes will be submitted to the competent court in the place of residence of POPEI (Eindhoven).
